OP Dhankar &amp; Ors<\/em><\/p>\n<p><span dir=\"LTR\"><strong>New Delhi [India], November 7: <\/strong>The <a href=\"https:\/\/theidrc.com\/\" target=\"_blank\" rel=\"noopener\"><u><strong>Indian Dispute Resolution Centre (IDRC)<\/strong><\/u><\/a>, in collaboration with\u00a0<strong>the Bar Council of India\u2019s India International University of Legal Education and Research (IIULER)<\/strong>, successfully hosted the\u00a0<strong>\u201c4th Arbitration in India Conclave 2025\u201d<\/strong> at the India International Centre, New Delhi.\u00a0Supported by CIArb and Vienna International Arbitration Centre, Austria. The Conclave brought together judges, legal luminaries, policymakers, and senior practitioners to deliberate on the theme \u201c<\/span><strong><span dir=\"LTR\">Autonomy and Accountability in Arbitration: Institutional Arbitration is the Way Forward.\u201d<\/span><\/strong><\/p>\n<p><strong><span dir=\"LTR\">Hon\u2019ble Union Minister for Law and Justice, Shri Arjun Ram Meghwal<\/span><\/strong><span dir=\"LTR\">, delivered the keynote address, outlining the Government\u2019s reform-oriented vision for ADR<\/span><strong><span dir=\"LTR\">.<\/span><\/strong><span dir=\"LTR\">\u00a0Stating that\u00a0<\/span><strong><span dir=\"LTR\">\u201cArbitration, Mediation, and Conciliation are essential tools for strengthening India\u2019s justice delivery and economic growth.\u201d\u00a0<\/span><\/strong><span dir=\"LTR\">Citing the\u00a0<\/span><strong><span dir=\"LTR\">Mediation Act, 2023<\/span><\/strong><span dir=\"LTR\">\u00a0and the forthcoming amendments to the\u00a0<\/span><strong><span dir=\"LTR\">Arbitration and Conciliation Act<\/span><\/strong><span dir=\"LTR\">, he said these initiatives would \u201cmake India a preferred seat for both domestic and international arbitration.\u201d<\/span><\/p>\n<p><span dir=\"LTR\">Shri Meghwal remarked that ADR mechanisms reflect <\/span><strong><span dir=\"LTR\">India\u2019s cultural and legal heritage<\/span><\/strong><span dir=\"LTR\">, noting that \u201cfrom Lord Krishna\u2019s mediation in the Mahabharata to today\u2019s institutional mechanisms, India has always valued resolution through dialogue and alternative modes.\u201d He called upon arbitration institutions to ensure <\/span><strong><span dir=\"LTR\">accessibility, affordability, and integrity<\/span><\/strong><span dir=\"LTR\">, noting that \u201c<\/span><strong><span dir=\"LTR\">judicial intervention should be limited, and efficiency must define India\u2019s dispute resolution landscape.<\/span><\/strong><span dir=\"LTR\">\u201d<\/span><\/p>\n<p><strong><span dir=\"LTR\">Hon\u2019ble Justice Manmohan, Supreme Court<\/span><\/strong><span dir=\"LTR\">, in his\u00a0<\/span><strong><span dir=\"LTR\">valedictory address<\/span><\/strong><span dir=\"LTR\">, called for\u00a0<\/span><strong><span dir=\"LTR\">institutional arbitration<\/span><\/strong><span dir=\"LTR\">\u00a0to evolve as a\u00a0<\/span><strong><span dir=\"LTR\">transparent and predictable<\/span><\/strong><span dir=\"LTR\">\u00a0system.<\/span><span dir=\"LTR\"><br \/>\n<\/span><span dir=\"LTR\">Praising IDRC\u2019s achievements, noting that the Centre had conducted over 3,000 arbitrations in five years and has become a \u201csymbol of India\u2019s commitment to establish an efficient and credible ADR ecosystem.\u201d<\/span><\/p>\n<p><span dir=\"LTR\">Justice Manmohan observed that \u201cCourts must act as facilitators, not barriers, to arbitration. Excessive judicial interference erodes the very purpose of alternative dispute resolution.\u201d<\/span><span dir=\"LTR\"><br \/>\n<\/span><span dir=\"LTR\">Highlighting the benefits of Institutional Arbitrations over ad hoc proceedings, he went on to suggest that a moratorium should be placed on all ad hoc arbitrations for a certain period so that institutional arbitration can be strengthened. Referring to the <\/span><strong><span dir=\"LTR\">Justice BN Shrikrishna Committee Report,<\/span><\/strong><span dir=\"LTR\">\u00a0he said India should promote arbitration institutions to become a global ADR hub.<\/span><\/p>\n<p><span dir=\"LTR\">He proposed\u00a0<\/span><strong><span dir=\"LTR\">strict timelines<\/span><\/strong><span dir=\"LTR\">\u00a0for enforcing awards under Sections 34 and 37 of the Arbitration Act to ensure time-bound disposal of arbitration challenges. The Hon\u2019ble Judge also urged the Government to revisit the\u00a0<\/span><strong><span dir=\"LTR\">Finance Ministry\u2019s circular<\/span><\/strong><span dir=\"LTR\">\u00a0restricting arbitration only to disputes valued less than Rs. 10 Crore, stating that \u201c<\/span><strong><span dir=\"LTR\">the Government must remain a part of the arbitration movement, not apart from it.<\/span><\/strong><span dir=\"LTR\">\u201d<\/span><\/p>\n<p><strong><span dir=\"LTR\">Panel Discussion was on \u201cAutonomy and Accountability in Arbitration: Institutional Arbitration is the way forward\u201d<\/span><\/strong><span dir=\"LTR\">\u00a0moderated by\u00a0<\/span><strong><span dir=\"LTR\">Dr Shashwat Bajpai<\/span><\/strong><span dir=\"LTR\">, Founder Partner, DSRB Law Chambers, with panellists:<\/span><\/p>\n<ul>\n<li><strong><span dir=\"LTR\">Mr S.D. Sanjay<\/span><\/strong><span dir=\"LTR\">, Additional Solicitor General of India, Supreme Court<\/span><\/li>\n<li><strong><span dir=\"LTR\">Ms Anuradha Dutt<\/span><\/strong><span dir=\"LTR\">, Senior Partner, DMD Advocates<\/span><\/li>\n<li><strong><span dir=\"LTR\">Mr Ayush Agarwala<\/span><\/strong><span dir=\"LTR\">, Partner, Bombay Law Chambers<\/span><\/li>\n<li><strong><span dir=\"LTR\">Ms Shruti Sabharwal<\/span><\/strong><span dir=\"LTR\">, Partner, Shardul Amarchand Mangaldas<\/span><\/li>\n<\/ul>\n<p><span dir=\"LTR\">Panellists unanimously agreed that institutional arbitration ensures quality, neutrality, and procedural discipline, unlike ad hoc arbitrations that often face delays and cost overruns.<\/span><\/p>\n<p><strong><span dir=\"LTR\">Ms Anuradha Dutt<\/span><\/strong><span dir=\"LTR\">\u00a0emphasised that \u201cIndia can only become a true arbitration hub if it combines institutional discipline with a predictable judiciary.\u201d<\/span><\/p>\n<p><strong><span dir=\"LTR\">Mr S.D. Sanjay<\/span><\/strong><span dir=\"LTR\">\u00a0highlighted that \u201cinstitutional systems help prevent arbitral fee abuse, avoid delays and promote fairness.\u201d<\/span><\/p>\n<p><strong><span dir=\"LTR\">Ms Shruti Sabharwal<\/span><\/strong><span dir=\"LTR\">\u00a0noted that \u201cstructured oversight, award scrutiny, and ethical accountability make institutional arbitration inherently superior to ad hoc ones\u201d<\/span><\/p>\n<p><strong><span dir=\"LTR\">Mr Ayush Agarwala<\/span><\/strong><span dir=\"LTR\">\u00a0added that \u201cefficiency, diversity among arbitrators, and digital adoption will determine the future success of arbitration in India.\u201d<\/span><\/p>\n<p><span dir=\"LTR\">Delivering the<\/span><strong><span dir=\"LTR\">\u00a0Welcome Address<\/span><\/strong><span dir=\"LTR\">,\u00a0<\/span><strong><span dir=\"LTR\">Ved Prakash Sharma, Advocate and Co-Chairman, BCI\u00a0<\/span><\/strong><span dir=\"LTR\">applauded the growing role of arbitration in modern dispute resolution. He highlighted the\u00a0<\/span><strong><span dir=\"LTR\">collaboration between BCI and IDRC<\/span><\/strong><span dir=\"LTR\">, stating that their joint efforts have been \u201cinstrumental in promoting awareness, education, and reforms that strengthen India\u2019s arbitration ecosystem.\u201d<\/span><\/p>\n<p><span dir=\"LTR\"><strong>Ms Sumedha Sindhu Rathi, Head of Operations and Member Secretary, Advisory Board, IDRC,\u00a0<\/strong>welcomed the dignitaries and participants, outlining IDRC\u2019s key functions and the benefits of Institutional Arbitration.\u00a0<\/span><strong><span dir=\"LTR\">Mr Divyansh H.
